Measures for the Administration of Environmental Impact Assessment of Construction Projects (for Trial Implementation) Order of the Ministry of Environmental Protection of the People's Republic of China (No. 37) The Measures for the Administration of Environmental Impact Assessment of Construction Projects (for Trial Implementation), as deliberated and adopted at the executive meeting of the Ministry of Environmental Protection on April 2, 2015, are hereby issued, and shall come into force on January 1, 2016. Annex: Measures for the Administration of Environmental Impact Assessment of Construction Projects (for Trial Implementation) Minister: Chen Jining December 10, 2015 Annex Measures for the Administration of Environmental Impact Assessment of Construction Projects (for Trial Implementation) Article 1 For the purpose of regulating the work of environmental impact assessment of construction projects, these Measures are developed in accordance with the Law of the People's Republic of China on Environmental Impact Assessment . Article 2 The term “environmental impact assessment” as mentioned in these Measures refers to the methods and institutions for conducting the follow-up monitoring and verification evaluation of the actual environmental impacts and the effectiveness of measures of pollution prevention and control, ecological protection, and risk prevention, putting forwards remedial measures or improvement measures, and improving the effectiveness of environmental impact assessment after the construction project for which a written report on environmental impacts is prepared passes the completion acceptance of environmental protection facilities and has been under steady operation for a given period. Article 3 Where, in the operation process of the following construction projects, there is any circumstance where the construction projects do not conform to the approved written report on environmental impact assessment, the environmental impact assessment shall be carried out: (1) construction projects of water conservancy, hydropower, excavation, port, and railways, which have great actual environmental impact degree and scope and whose major environmental impacts are to gradually appear in a given period after completion and operation and other construction projects in other industries crossing major ecological sensitive areas; (2) construction projects of metallurgy, petrifaction, and chemical engineering, which have major environmental risks and sensitive construction locations, and continuously emit heavy metal or persistent organic pollutants; and (3) other construction projects where the competent department of environmental protection approving the written report on environmental impacts holds that an environmental i......
