Provisions on the Safety Training of Production and Operation Entities (2015 Amendment) Provisions on the Safety Training of Production and Operation Entities (Issued by the Order No. 3 of the State Administration of Work Safety on January 17, 2006, Amended for the first time by the Order No.63 of the State Administration of Work Safety on August 29, 2013, and Amended for the second time by the Order No.80 of the State Administration of Work Safety on May 29, 2015) Chapter I General Provisions Article 1 With a view to strengthening and regulating the work for safety training of production and operation entities, improving the safety quality of practitioners, preventing accidents of death and injuries, and alleviating occupational hazards, the present Provisions are formulated in accordance with the Work Safety Law and the relevant laws and administrative regulations. Article 2 The present Provisions shall be applicable to the safety training of the practitioners in the production and operation entities of industrial, mining and commercial/trading sectors (hereinafter referred to as the production and operation entities). Article 3 A production and operation entity shall be responsible for the work of safety training of practitioners of its own entity. A production and operation entity shall establish and perfect the safety training work system in accordance with the Work Safety Law and the relevant laws and administrative regulations, as well as the present Provisions. Article 4 The practitioners who shall be subject to safety training of a production and operation entity shall include the main persons in charge, work safety management personnel, special operation personnel, and other practitioners. A production and operation entity using dispatched workers shall include dispatched workers in its own employees for unified management, and provide dispatched workers with education and training on safe operating procedures and safe operating skills for the relevant posts. The supplier of dispatched workers shall provide necessary work safety education and training for them. A production and operation entity receiving interns from secondary vocational schools or institutions of higher education shall provide corresponding work safety education and training for interns, and provide necessary labor protection products. The schools shall assist the production and operation entity in providing work safety education and training for interns. Production and operation entities shall provide their employees with work safety education and training to ensure that their employees have necessary work safety knowledge, are familiar with the relevant work safety policies and rules and safe operating procedures, possess the safe operating skills for their respective posts, know the emergency response measures for accidents, and are informed of their rights and obligations in work safety. Employees failing the work safety training shall not take their posts. Article 5 The State Administration of Work Safety (hereinafter referred to as the SAWS) shall guide the safety training work countrywide, and conduct supervision and administration on the safety training work countrywide according to law. The relevant competent departments of the State Council shall guide and supervise the safety training work of their own industries according to their own functions, and formulate implementation measures in accordance with the present Provisions. The State Administration of Coal Mine Safety (hereinafter referred to as SACMS) shall give guidance and supervision over the coal mine safety training work countrywide. The departments of work safety supervision and administration at all levels and the coal mine safety supervision institutions (hereinafter referred to as the departments of work safety supervision and surveillance) shall conduct supervision and administration on the safety training work of production and operation entities according to law pursuant to their own functions. Chapter II Safety Training on the Main Person in Charge and Safety Production Management Personnel Article 6 The main person in charge of a production and operation entity and the work safety management personnel thereof shall accept safety training, and shall have work safety knowledge and management ability adapted to the production and operation activities undertaken by them. Article 7 The safety training on the main person in charge of a production and operation entity shall include the following contents: 1. The work safety guidelines and policies of the state and the relevant work safety laws, regulations, rules and standards; 2. Basic knowledge on work safety management, work safety technology, and work safety professional knowledge; 3. The relevant provisions on management of major hazard sources, prevention of major accidents, emergency management and rescue organization, and accident investigation and handling; 4. Occupational hazards and measures of prevention thereof; 5. Advanced work safety management experience home and abroad; 6. Analysis on typical accidents and emergency rescue cases; and 7. Other necessary training contents. Article 8 The safety training on the work safety personnel of a production and operation entity shall include the following contents: 1. The work safety guidelines and policies of the state and the relevant work safety laws, regulations, rules and standards; 2. Knowledge on work safety management, work safety technology, and professional sanitation; 3. Statistics and report on accidents of death and injuries and method for investigation and handling of occupational hazards; 4. Compilation of emergency management and emergency preparedness plan and the contents and requirements for emergency disposal; 5. Advanced work safety management experience both home and abroad; 6. Analysis on typical accidents and emergency rescue cases; and 7. Other necessary training contents. Article 9 The time for preliminary safety training on the main person in charge of a production and operation entity and the work safety management personnel thereof shall be no less than 32 teaching hours. And the retraining time each year shall be no less than 12 teaching hours. The time for preliminary safety training for the main persons in charge of such production and operation entities as coal mines, non-coal mines, dangerous chemicals enterprises, fireworks and firecrackers enterprises, and metal smelters, among others, and the work safety management personnel thereof shall not be less than 48 periods, and the retraining time each year shall not be less than 16 periods. Article 10 The safety training on the main person in charge of a production and operation entity and the work safety management personnel thereof shall be carried out in accordance with the safety training syllabus formulated by the departments of work safety supervision and surveillance.
