Administrative Measures for the Circulation of the Used Electrical and Electronic Products Order of the Ministry of Commerce (No. 1 [2013]) The Administrative Measures for the Circulation of the Used Electrical and Electronic Products, as deliberated and adopted at the 74th executive meeting of the Ministry of Commerce on February 17, 2013, are hereby issued, and shall come into force on May 1, 2013. Minister: Chen Deming March 15, 2013 Administrative Measures for the Circulation of the Used Electrical and Electronic Products Article 1 In order to strengthen the administration of the circulation of the used electrical and electronic products, promote the comprehensive utilization of resources, and protect environment, these Measures are formulated in accordance with the Circular Economy Promotion Law of the People's Republic of China, the Regulation on the Administration of Recovery and Disposal of Waste Electrical and Electronic Products and other laws and regulations. Article 2 For the purpose of these Measures, “used electrical and electronic products” means the electrical and electronic products which have flowed into the consumption field but maintain all or part of the original use values, including refrigeration and air-conditioning apparatuses, cleaning instruments, kitchen utensils, ventilation apparatuses, heating and ironing apparatuses, personal care appliances, health-care instruments, entertainment equipment and other electrical appliances and audio-visual entertainment, IT and other types of electronic products. For the purpose of these Measures, “used electrical and electronic products operators” (hereinafter referred to as “operators”) means the legal persons, other economic organizations and individual businesses engaging in the activities concerning purchase or sale of the used electrical and electronic products. Article 3 For the purpose of these Measures, “circulation of the used electrical and electronic products” means the activities concerning operators' purchase or sale of the used electrical and electronic products. Article 4 Operators shall engage in business activities in accordance with laws, regulations and the relevant standards, and follow the principles of honesty, trustworthiness, fairness and openness. Article 5 The Ministry of Commerce shall be responsible for the administration of the used electrical and electronic products circulation industry, and for the formulation of the industry development plans and policies. The local competent authorities of commerce at or above the county level shall be responsible for the administration of the used electrical and electronic products circulation industry within their respective administrative regions. Article 6 The relevant industry associations shall, in accordance with the provisions of bylaws, actively serve operators, organize professional skills trainings, improve the archival information system for the used electrical and electronic products, build the archival repository for the honest business of practitioners, and exert the self-disciplinary role of the i......
