Provisions on the Standards for Compulsory Retirement of Motor Vehicles
Order of the Ministry of Commerce, National Development and Reform Commission, the Ministry of Public Security, and the Ministry of Environmental Protection
(No. 12 [2012])
The Provisions on the Standards for Compulsory Retirement of Motor Vehicles, as deliberated and adopted at the 68th executive meeting of the Ministry of Commerce on August 24, 2012 and approved by the National Development and Reform Commission (“NDRC”), the Ministry of Public Security and the Ministry of Environmental Protection, are hereby issued and shall come into force on May 1, 2013. The Notice on Issuing the Standards for Retirement of Automobiles (No. 456 [1997] of the State Economic and Trade Commission), the Notice on Adjusting the Standards for Retirement of Light Trucks (No.407 [1998] of the State Economic and Trade Commission), the Notice on Adjusting Several Provisions on the Standards for Retirement of Automobiles (No.1202 [2000] of the State Economic and Trade Commission), the Notice on Issuing the Standards for Retirement of Agricultural Transport Vehicles (No.234 [2001] of the State Economic and Trade Commission), and the Interim Provisions on the Standards for Retirement of Motorcycles (No. 33 [2002] of the State Economic and Trade Commission, State Development and Planning Commission, Ministry of Public Security, and State Environmental Protection Administration) shall be concurrently repealed.

Provisions on the Standards for Compulsory Retirement of Motor Vehicles
Article 1 In order to guarantee road traffic safety, encourage technological progress, accelerate the construction of a resource conserving and environmentally friendly society, these Provisions are formulated in accordance with the Road Traffic Safety Law of the People's Republic of China and its Implementation Regulation, the Law of the People's Republic of China on the Prevention and Control of Atmospheric Pollution , and the Law of the People's Republic of China on the Prevention and Control of Environmental Noise Pollution.
Article 2 According to the use, safety technology and emission inspection of motor vehicles, the State shall conduct compulsory retirement for the motor vehicles that reach the standards for being discarded.
Article 3 The departments of commerce, public security, environmental protection, development and reform shall, in accordance with their respective duties, be responsible for relevant work on the supervision and administration of the recycling and dismantling of retired motor vehicles and the implementation of standards for compulsory retirement of motor vehicles.
Article 4 Where a registered motor vehicle falls under any of the following circumstances, it shall be compulsorily discarded, and shall be sold by its owner to a retired motor vehicle recycling and dismantling enterprise which shall conduct registration, dismantling, destruction, processing in accordance with the Provisions, and submit the registration certificate, plate and vehicle license of the retired motor vehicle to the traffic administrative department of the public security organ for cancellation.
(1) Having been in use for a certain number of years set forth in Article 5 of these Provisions;
(2) Failing to meet the relevant requirements on in-service vehicles specified in the national standards of safety technologies of motor vehicles after repair and adjustment;
(3) Failing to meet the relevant requirements on in-service vehicles in respect of emission of pollutants to the air or noise after the repair and adjustment or application of control technologies; or
(4) Failing to obtain the successful inspection mark for motor vehicles within three consecutive vehicle inspection periods after the expiry of its inspection term.
Article 5 The service life of various motor vehicles is as follows:
